Virgin Australia and Visit Victoria Last Flight Club event (the Event)
A. General
1. The terms of this document, information on how to enter this Event and mechanics of entry form part of the terms and conditions for entry into this Event (Terms and Conditions). Registering for attendance at this Event is deemed acceptance of these Terms and Conditions by each Participant.
2. Any Australian resident, aged 18 and older can be a “Participant”.
3. This Event is jointly provided by Virgin Australia Airlines Pty Ltd (ABN 36 090 670 965) of 275 Grey Street, South Brisbane, Queensland, 4101 (Virgin Australia) and Visit Victoria Limited (VVIC) ABN 37 611 725 270 of Level 8, 271 Spring Street, Melbourne VIC 3000 (together the Event Promoters).
4. Registration for this Event commences at 12:00am AEST on Monday 7 July 2025 and ends at 11:59pm AEST on Wednesday 23 July 2025 (Registration Period).
B. Entry
5. To register for the Event, Participants must:
(a) book the last Virgin Australia domestic flight from Sydney to Melbourne on 7 August 2025, departing at 8:30pm (timing is subject to change): VA892 (Melbourne Flight); and
(b) book the first Virgin Australia domestic flight from Melbourne to Sydney on 8 August 2025, departing at 6:00am (timing is subject to change): VA803 (Sydney Flight); and
(c) navigate to the Event registration form on the Event landing page (Event Registration Form); and
(d) during the Registration Period, enter their first name, last name, email address, and date of birth on the Event Registration Form. For clarity, the Participant’s name must match the name on the booking for both the Melbourne Flight and Sydney Flight; and
(e) must acknowledge that the Event will involve all-night activities and confirm that they are in good physical and mental health and have no known medical conditions or impairments that would prevent them from safely participating in any activities associated with the Event; and
(f) select “yes” to the Event Promoters sharing the information in the Event Registration Form with one another and any event organisers; and
(g) agree to these Terms and Conditions.
Participants will only be accepted to attend this Event if they meet all of the criteria set out above when they register for the Event.
6. Registrations will be deemed accepted at the time of receipt by the Event Promoters and not at the time of transmission. Registrations received will be considered final by the Event Promoters. Illegible, incomprehensible and incomplete registrations will be deemed invalid. The Event Promoters accept no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Event Promoters.
7. Costs associated with entering the Event remain a Participant’s responsibility and may vary.
8. Entries not fully complying with these Terms and Conditions may be deemed invalid at the Event Promoters’ discretion.
C. Confirming registration
9. The maximum possible number of successful Participants will be determined by the availability of eligible seats on the Melbourne Flight and Sydney Flight during the Registration Period. Successful Participants will be notified via email from Virgin Australia by 31 July 2025. When contacted, successful Participants will be required to complete further documentation as and, in the form, required by the Event Promoters in their absolute discretion, including but not limited to a legal release and limitation of liability form. Participation in the Event is subject to completion of this documentation.
10. The Event Promoters may in their absolute discretion deem a "successful" entry invalid after an Entrant is notified if it is discovered that the Entrant did not register in accordance with these Terms and Conditions.
11. If an Entrant fails to respond to the Event Promotor’s email or contact the Event Promotor to confirm their attendance by 09:00AM on the 6th of August, 2025 the Entrant is no longer eligible to participate in the Event. The Event Promotors’ decision is final and binding, and no correspondence will be entered into regarding this decision.
12. If you register to attend the Event but no longer wish to participate, please email brand.enquiries@virginaustralia.comand you will be removed from the Event. For clarity, this will not change your Melbourne Flight or Sydney Flight bookings. Please refer to the Virgin Australia website or contact our Guest Contact Centre on 13 67 89 for information on how to change or cancel your flight(s). Any changes made to your flights will be subject to the Virgin Australia fare rules. Please refer to your ticket(s) for further details.
D. The Event
13. The Event will involve:
(a) Entertainment onboard the Melbourne Flight;
(b) Exclusive performance at the Virgin Australia Lounge Melbourne Airport (following arrival of the Melbourne Flight);
(c) Lego Star Wars tour at the Melbourne Museum;
(d) Dinner and Cocktail Masterclass at the Melbourne Supper Club;
(e) Private meet and greet at the Melbourne Cricket Ground; and
(f) Access to Virgin Australia Lounge Melbourne Airport prior to Sydney Flight.
Participation in the each of these activities may be subject to additional terms and conditions imposed by each relevant venue or operator, which will be communicated to the Participant during the Event.
14. Lounge access is subject to availability and use of the Lounge is subject to the Virgin Australia Lounge Terms and Conditions.
15. Each Participant is responsible for all other expenses including, but not limited to, travel to and from Sydney Airport, spending money, meals, drinks, incidentals, taxes, gratuities, service charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
16. The Event Promoters make no representation as to the safety, conditions or other issues that may exist at any destination or as part of the Event.
17. Participants are solely responsible for ensuring that they arrive at each departure point with sufficient time to check-in and board any scheduled flight, transfers or other travel arrangements in connection with the Event. The Event Promoters are not responsible for any costs, losses, or missed opportunities resulting from a Participant’s failure to meet travel times or connections, regardless of the cause.
18. If any component of the Event itinerary is unavailable, for any reason (including adverse weather, venue capacity or other unforeseeable or other special circumstances), the Event Promoters, in their absolute and sole discretion, reserves the right to substitute or cancel an activity. To the extent permitted by law:
(a) the Event Promoters make no representations or warranties as to the Event itinerary; and
(b) the Event Promoters will not be responsible for any act, omission, failure or delay in relation to the Event or its itinerary not reasonably within its control; and
(c) no compensation will be payable if, for any reason, the Entrant is unable to participate in the Event as described in these Terms and Conditions.
E. Contacting the Participant
19. By registering for this Event, Participants agree to be contacted in relation to this Event by the Event Promoters. Should a Participant’s contact details change prior to the Event, it is the Participant’s responsibility to notify the Event Promoters. A request to access or modify any information provided in a registration should be directed to the Event Promoters.
20. Participants consent to the Event Promoters using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Event and any products or services offered by the Event Promoters.
21. If for any reason a Participant fails to participate in the Event, their registration will be forfeited and the Participant will have no further claim, recourse, or entitlement to compensation, or reimbursement of any kind.
22. The Event Promoters reserve the right to request that a Participant provides proof of identity and proof of age in order to participate in the Event. Proof of identification and age considered suitable for verification is at the discretion of the Event Promoters (or their nominated third parties). In the event that a Participant cannot provide suitable proof, the Participant will not be able to participate in the Event and will have no further claim, recourse, or entitlement to compensation, or reimbursement of any kind.
F. Privacy
23. The Event Promoters are collecting your personal information for the purpose of conducting the Event, including providing any activities in connection with the Event. If the Event Promoters cannot collect your personal information, you may not be able to register for the Event. Virgin Australia Privacy Policy (www.virginaustralia.com/privacy) and VVIC Privacy Policy’s (www.visitmelbourne.com/legal-notices/privacy-policy) also state how you can seek to access or correct your personal information and how to make a privacy complaint. You can contact the Virgin Australia Privacy Officer at privacy@virginaustralia.com and the VVIC Privacy Officer atprivacy@visitvictoria.com.au. Without limiting the foregoing, the Event Promoters may disclose Participants’ personal information to other parties assisting in the administration of the Event, including to the Event Promoter’s related entities, subcontractors, suppliers, external service providers and third parties as required by law. By accepting these Terms and Conditions, the Participant consents to Event suppliers and subcontractors using the Participants’ personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any of all of them.
G. Tax
24. The Event Promoters will not be liable for any tax liability, including without limitation income tax, fringe benefits tax, or any liability or loss of opportunity due to reportable fringe benefits, incurred by a Participant and/or another party in regards to any connection with participating in the Event.
25. Participants and/or any such relevant party will be required to pay any taxes and other airport related charges (including any applicable GST on those taxes and charges) which may be due on participation in the Event.
26. Participants should seek independent financial advice to ensure they understand possible tax implications in relation to any tax liability and/or reportable fringe benefits before registering for and attending the Event.
27. The Event Promoters, their agents and associated entities do not accept responsibility for and make no representations about any tax liability as a result of participating in the Event.
28. The Event Promoters must ensure that all promotional and marketing material prepared relating to the Event sufficiently notifies Participants of these conditions.
29. The Event Promoters, their agents and associate companies are not responsible for and exclude all liability (including negligence), for any variation in the Event inclusions to that stated in these Terms and Conditions.
H. Legal
30. The Event Promoters reserve the right to verify the validity of entries and to disqualify any entry which in the opinion of an Event Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Participant who tampers with the registration process, who submits an registration that is not in accordance with these Terms and Conditions or who has, in the opinion of an Event Promoter, engaged in conduct in entering the Event which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Event and/or an Event Promoter. The Event Promoters reserve the right to disqualify a Participant if the Event Promoters become aware that the Participant and/or the Participant’s registration is of a type described in this clause. Any Participant disqualified under this clause is prohibited from any further participation in the Event. Errors and omissions may be accepted at the Event Promoters’ discretion. Failure by the Event Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. The Event Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
31. If there is a dispute as to the identity of a Participant, the Event Promoters reserve the right, in their sole discretion, to determine the identity of the Entrant.
32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Event Promoters’ ability to proceed with the Event on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Event Promoters may in their absolute discretion cancel the Event.
33. If for any reason this Event, including the registration for this Event, is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Event Promoters, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Event, the Event Promoters reserve the right in their sole discretion to disqualify any individual who tampers with the registration process, take any action that may be available and to cancel, terminate, modify or suspend the Event, or invalidate any affected entries.
34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) in Australia, or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). The Event Promoters and their associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this Event. This includes, but is not limited to:
(a) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Event and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this Event as a result of any technical malfunctions, delays or failures;
(b) theft, unauthorised access or third party interference;
(c) lost or damaged entries;
(d) participation in the Event; and
(d) any variation to the Event including modifications to its itinerary.
35. The Event Promoters reserve the right in their sole discretion to disqualify any individual who the Event Promoters have reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Event. Any Participant disqualified under this clause is prohibited from any further participation in the Event. The Event Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
36. The Event Promoters and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of registrations, and reserves the right to take any action that may be available.
37 .These Terms and Conditions are governed by the laws of Queensland, Australia.
